Welcome back everyone. Today, my guest is Lauren Stumpf, Media Communications and Client Services Coordinator with Rancho Mesa. We’re going to talk about employment law updates for 2022. Lauren, welcome to the show.
Lauren Stumpf: Thanks for having me, it’s always great to be back.
AB: Now, we just hosted our annual employment law update webinar where Thomas E. Daugherty from Klinedist Attorneys gave us an overview of changes California employers should be aware of as we go into 2022. What are some of the topics Tom covered in the presentation?
LS: Well, COVID was certainly a hot topic during the webinar. Tom covered the current status of the federal vaccine mandate for employers with 100 or more employees. He explained California employers can mandate employees be vaccinated and included things to consider, as well as how to accommodate medical and religious exemptions.
AB: We’re certainly getting more and more questions about implementing vaccination mandates and/or weekly testing. And Cal/OSHA will really determine what will be required and what’s optional. In fact, Cal/OSHA just delayed adoption of a revised Emergency Temporary Standard until December 2021. So, we’ll have to wait to see what happens with that. What else did Tom cover?
LS: So, he talked about increases to minimum wage and exempt salary thresholds, changes to the California Family Rights Act, and how wage theft could be prosecuted as a felony.
AB: Okay, was there anything else that employers should know about?
LS: Yeah, Tom also mentioned there’s changes to who’s required to get a criminal background check when supervising children, an extension of the ABC test for independent contractors, prohibiting non-disclosure agreements as a settlement requirement when harassment or discrimination is involved, and Cal/OSHA’s expanded enforcement capabilities.
